Terms of Service

1The Service

KidsGate Global provides an educational platform offering English and Mathematics curriculum content for children aged 5 to 12 (Grades 1 to 6), aligned to the Cambridge English curriculum and International Mathematics standards. The Service includes lessons, quizzes, games, adaptive assessments, a parent dashboard, a token reward system, and access to the KidsGate Store.

2Accounts and Eligibility

• You must be at least 18 years old to create an account. Children use the Service through a parent or guardian account.
• You agree to provide accurate and complete registration information and to keep it up to date.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You must notify us immediately at [email protected] if you suspect unauthorised access to your account.
• We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

3Subscription, Billing, and Free Trial

3.1 Free Trial

New accounts receive a 14-day free trial. No charge is made during the trial period. You may cancel at any time before the trial ends without incurring any charge.

3.2 Subscription Plans

After the free trial, access to the Service requires a paid subscription. Current plan pricing is displayed on our Pricing page and is denominated in USD. Plans are available on a monthly or annual basis.

3.3 Billing

Subscriptions are billed in advance at the start of each billing period. Payment is processed securely by Stripe. By providing your payment details, you authorise us to charge your payment method on a recurring basis until you cancel.

3.4 Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. We do not provide refunds for unused portions of a billing period, except where required by applicable consumer protection law.

3.5 Price Changes

We may change subscription prices with at least 30 days' notice. If you do not agree to a price change, you may cancel before the change takes effect.

4Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Attempt to gain unauthorised access to any part of the Service, our servers, or any connected systems.
• Reverse engineer, decompile, or attempt to extract the source code of the Service.
• Use the Service to transmit any harmful, offensive, or inappropriate content.
• Create multiple accounts to circumvent restrictions or obtain additional free trials.
• Use automated tools, bots, or scripts to access or interact with the Service.
• Reproduce, redistribute, or resell any content from the Service without our express written permission.

5Content and Intellectual Property

All content on the KidsGate Global platform, including lessons, curriculum materials, software, graphics, audio, video, and the KidsGate brand, is owned by or licensed to KidsGate Global and is protected by copyright, trademark, and other intellectual property laws.

Your subscription grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for personal, non-commercial educational purposes for the child profiles on your account. No other rights are granted.

You retain ownership of any content you submit to us (such as feedback). By submitting content, you grant us a licence to use it to improve the Service.

6Leaderboard and Rewards

The KidsGate leaderboard displays a child's chosen display name and country. By participating, you consent to this limited information being visible to other users globally.

Tokens earned in the Service may be used only within the KidsGate Store and have no monetary value. Tokens are non-transferable and expire upon account closure.

7Disclaimers

The Service is provided on an 'as is' and 'as available' basis. To the maximum extent permitted by law, we make no warranties, express or implied, including as to the accuracy, completeness, or fitness of the Service for any particular purpose. Educational outcomes cannot be guaranteed and will vary depending on the child's engagement and individual circumstances.

8Limitation of Liability

To the maximum extent permitted by applicable law, KidsGate Global's total liability to you for any claim arising from or related to these Terms or the Service shall not exceed the amount you paid to us in the 12 months preceding the claim. We are not liable for any indirect, incidental, consequential, or punitive damages.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Australian Consumer Law, including guarantees as to acceptable quality and fitness for purpose.

9Indemnification

You agree to indemnify and hold harmless KidsGate Global, its officers, directors, employees, and agents from and against any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the Service or your breach of these Terms.

10Termination

We may suspend or terminate your account immediately if you breach these Terms, engage in fraudulent activity, or if we are required to do so by law. Upon termination, your licence to use the Service ends immediately. Provisions that by their nature should survive termination (including intellectual property, limitation of liability, and governing law) shall continue to apply.

11Changes to These Terms

We may update these Terms from time to time. We will give you at least 14 days' notice of material changes via email or a notice on the platform. Continued use of the Service after the effective date of changes constitutes acceptance of the updated Terms.

12Governing Law and Disputes

These Terms are governed by the laws of New South Wales, Australia. Any dispute that cannot be resolved informally will be submitted to the exclusive jurisdiction of the courts of New South Wales, Australia, except where mandatory consumer protection laws in your jurisdiction provide otherwise.
